These Terms of Service ("Terms") govern your access to and use of FB Grow (the "Service"). By creating an account, signing in, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility & account
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to enter into a binding contract to use the Service. You are responsible for the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use.
2. The Service
FB Grow is a third-party tool that helps you launch and manage Facebook ad campaigns by acting on your behalf via Meta's official Marketing API. We are not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. All Meta trademarks are the property of their respective owners.
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own internal business purposes. You may not resell, sublicense, or white-label the Service without our prior written consent.
4. Acceptable use
You agree not to:
- Use the Service to violate any law, regulation, or third-party right.
- Run advertising campaigns that violate Meta's Advertising Standards or community guidelines.
- Reverse-engineer, decompile, or attempt to extract our source code.
- Probe, scan, or test the vulnerability of any system or network.
- Use the Service to send spam, phishing content, malware, or any abusive content.
- Circumvent rate limits, authentication, or other technical restrictions.
- Resell or share your account with anyone outside your organization.
5. Your content
You retain all ownership rights to the creatives, ad copy, audience data, and any other content you upload to the Service ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free license to host, store, and transmit Your Content solely for the purpose of operating the Service on your behalf — including forwarding it to Meta when you launch a campaign. You are solely responsible for Your Content and for ensuring you have the rights to use it.
6. Third-party services
The Service connects to Meta's Marketing API and Google's authentication APIs. Your use of those services is subject to their own terms and policies, including Meta's Platform Terms and Google's Terms of Service. We are not responsible for outages, errors, or policy changes from those providers.
7. Fees
The Service may offer free and paid tiers. Pricing for paid tiers is shown on the pricing page and may change with reasonable notice. Fees are billed in advance, non-refundable except where required by law, and exclude any applicable taxes. Failure to pay may result in suspension or termination of your account.
8. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if we suspect fraud or abuse, or if we are required to do so by law. Sections that by their nature should survive termination (such as ownership, indemnification, disclaimers, limitation of liability, and governing law) will survive.
9. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any campaign results, ROAS, or ad spend efficiency will be achieved.
10. Limitation of liability
To the maximum extent permitted by law, in no event shall FB Grow, its officers, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with these Terms or the Service. Our total aggregate liability for any claim arising out of or in connection with these Terms shall not exceed the greater of (a) the amounts you paid us in the twelve (12) months preceding the claim, or (b) USD 100.
11. Indemnification
You agree to indemnify and hold harmless FB Grow and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to (a) Your Content, (b) your use of the Service, or (c) your breach of these Terms or any applicable law.
12. Changes to the Service or Terms
We may modify the Service or these Terms at any time. We will post the revised Terms with an updated "Last updated" date. Material changes will be communicated via email or a prominent notice in the Service. Your continued use of the Service after such changes take effect constitutes acceptance of the new Terms.
13. Governing law & disputes
These Terms are governed by the laws of the jurisdiction where FB Grow is registered, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms will be resolved in the competent courts of that jurisdiction, unless mandatory consumer protection laws of your residence require otherwise.
